Officer cleared in fatal shooting in front of LDS Temple

The Salt Lake County District Attorney’s Office cleared South Jordan police Officer Matt Pennington in the fatal shooting of a 54-year-old man on the grounds of the Oquirrh Mountain LDS Temple on Christmas Day.

Using deadly force in this case was justified because Daniel M. Pogue posed a threat of death or serious bodily injury to officers or those in the area if not apprehended, the D.A.’s Office determined.

Officers went to the temple as a result of reports of an armed man acting erratically, police said.
